The Supreme Court held that the applicants' appeal was filed out of time due to a lack of diligence by their counsel, who failed to collect the proceedings promptly after being notified by letter dated 13/9/2002. The court found that the letter was delivered to the applicants' counsel, and thus the statutory period for filing the appeal began from that date. The appeal was therefore lodged 31 days out of time. However, the court exercised its discretion under Rule 4 to grant an extension of time, holding that the lack of diligence was attributable to counsel and not the applicants themselves.…
