The applicant demonstrated a legitimate interest in the suit land by virtue of purchase from the registered proprietor and subsequent possession and development. The Registrar of Titles failed to provide reasons for refusing to register the caveat or the applicant as proprietor. The court found that the applicant's interest warranted protection through registration of a caveat, in line with statutory provisions and case law.
