In the matter of M/s Equator Growers (Company Cause 5 of 1992) [1992] UGHC 33 (25 September 1992)
The court found that the applicant failed to provide sufficient evidence to establish his status as a shareholder in M/S Equator Growers Uganda Limited. Essential documents such as share certificates, proof of payment, and the memorandum and articles of association were not produced. The applicant did not obtain evidence from the Registrar of Companies to support his claim. Without this evidence, the court could not be satisfied that the applicant was entitled to rectification of the company register. The burden of proof was not discharged, and therefore, the application was dismissed.
