Holding and result

The court found that the prosecution had proved all three ingredients of the offence of defilement beyond reasonable doubt: the complainant was under 18 years of age, sexual intercourse occurred on the day in question, and the accused was identified as the perpetrator. The evidence of the complainant, corroborated by her father and grandmother, was credible and unchallenged. The accused was found in flagrante delicto by the complainant's father. The court disregarded the unauthenticated medical report but relied on direct witness testimony. In agreement with the assessors, the accused was convicted of defilement under section 123(1) of the Penal Code Act and sentenced to twelve years' imprisonment, with the period spent on remand taken into account.

Questions and positions

Legal issues

Party arguments

Applicant
The prosecution argued that the accused, Semiyingo Paul, committed the offence of defilement against an 8-year-old girl. The prosecution presented five witnesses, including the complainant, her father, grandmother, and the arresting officer. The prosecution emphasized the seriousness of the offence, the vulnerability of the victim, and the need for a deterrent sentence due to the accused's abuse of trust and the gravity of the harm caused.
Respondent
The defence, represented by Mrs. Bagambe, argued for leniency on the grounds that the accused is a first offender, an elderly man, and has been on remand since December 1998. The accused himself pleaded for a lenient sentence, citing his age, health issues, and family responsibilities. The defence requested that the period spent on remand be considered in sentencing.

Court’s reasoning

Section 123(1) of the Penal Code Act

Defilement is committed when a person has unlawful sexual intercourse with a girl under the age of 18 years.

  2. 02

Archbold, Criminal Pleading Evidence and Practice, 38th edition at page 2873 para 2872

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • The court deliberately ignored the medical report as it was unauthenticated and lacked a date, emphasizing the importance of authentic evidence in criminal trials.
  • The expectations of society and the stigma inflicted on the complainant were considered in determining the sentence, highlighting the court's role in protecting vulnerable victims.

Court disposition

conviction and custodial sentence

  • The accused is convicted of defilement contrary to section 123(1) of the Penal Code Act.
  • The accused is sentenced to twelve years' imprisonment.
  • The period spent on remand shall be taken into account in computing the sentence.

Medical evidence was admitted under Indictments Decree. \par The accused had no witness and for his defence decided to keep quiet. \par The prosecution case is briefly as follows: \par At about 4.00 p.m. on 6th December, }{\lang1033\langfe2057\langnp1033\insrsid8389544 1998, the complainant was at }{\lang1033\langfe2057\langnp1033\insrsid2586025\charrsid11231130 the home of her grandmother, PW3, with two other women, one Nabyesero who has since died and a

female visitor who had come with a child. It was then that the accused who lived in the neighbourhood and is related to the father of the complainant appeared and asked the complainant to accompany him in order that he might give the complainant some Irish potatoes to carry back to the complainant\rquote s grandmother, PW3. Without hesitation, the complainant did }{\lang1033\langfe2057\langnp1033\insrsid10177610\charrsid11231130 as}{\lang1033\langfe2057\langnp1033\insrsid2586025\charrsid11231130 she was told and later arrived together with accused at the garden of the accused where accused proceeded to harvest some Irish potatoes and deposit them in a polythene bag. No sooner had he deposited the potatoes in the polythen e bag than he suggested he and the complainant proceed to accused\rquote s banana plantation nearby where he could harvest a bunch of banana, also to be taken to complainant\rquote s grandmother. Meanwhile the polythene bag together with its contents were left in the garden. On arrival in the banana plantation accused got hold of the complainant and lay her upon her back on the grass and proceeded to tear complainant\rquote s knickers. Accused pulled his trousers down to his feet, lay upon the complainant and inserted his penis in her vagina. The complainant cried out in pain and her cries were later heard by her father, PW2. When PW2, together with a Matovu

Sunday, who had been searching for complainant heard her cries they went to the source of the noise and found accused lyi ng on top of the complainant with his penis inside the complainant\rquote s vagina. They pulled the accused from the complainant and took both accused and complainant to the village authorities and later to Police.
