Holding and result

The Supreme Court held that the appellant, Resty Nantongo, had a registered leasehold interest in the disputed land and permission to develop it. The respondent, David Kayondo, had only an unregistered transfer and had not challenged the validity of the lease. The High Court erred in granting an injunction restraining the appellant from exercising her rights under the lease, as the respondent failed to establish a strong case to justify such relief. The registered leasehold interest was the only valid interest between the parties, and the operation of the lease rendered the dispute over the purchase agreements immaterial for the purposes of the injunction. The appeal was allowed, the interim injunction discharged, and costs awarded to the appellant.

Court disposition

Orders

Questions and positions

Legal issues

Party arguments

Applicant
The appellant argued that she held a registered leasehold interest in the disputed land, Kibuga Block 7 Plot No. 67 at Ndeeba, and had obtained permission to build from the Kampala City Council. She contended that the respondent's claim was based on an unregistered transfer and that the caveat lodged by her was valid. The appellant maintained that the injunction granted by the High Court was improper as it denied her rights under the registered lease.
Respondent
The respondent asserted that he had entered into an agreement to purchase the land and had presented a transfer for registration. He argued that his interest should take priority over the appellant's claims, despite the lease registration. The respondent did not challenge the validity of the lease but maintained that his executed transfer should be given precedence.

Court’s reasoning

  1. 01

    Halsbury's Laws of England, 3rd Ed. 21 p 3.66

A registered interest in land prevails over unregistered claims unless the registration is set aside for a valid reason.

  2. 02

    Halsbury's Laws of England, 3rd Ed. 21 p 3.66

An injunction should only be granted where the applicant shows a strong case for doubting the existence of the right being exercised by the respondent.

  3. 03

    Haters v. Akira Branch (1972) E.A. 347, 350

It is prudent to require the plaintiff to prosecute the case within a reasonable time and to enter into an undertaking as to damages when granting a temporary injunction.

06

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • When granting a temporary injunction, courts should require the plaintiff to prosecute the case within a reasonable period and enter into an undertaking as to damages.
  • Limiting the duration of injunctions to three or four months may prevent abuse of court process.
  • The wisdom of requiring undertakings as to damages is to prevent abuse and ensure fairness in interlocutory proceedings.

Court disposition

appeal_allowed

  • The interim injunction restraining the appellant from entering and developing the land is discharged.
  • Costs awarded to the appellant in both the Supreme Court and High Court.
