Holding and result

The Court of Appeal found that the trial judge erred by convicting the appellant based on the uncorroborated evidence of the victim, particularly when medical evidence did not support recent defilement. The victim was examined the day after the alleged incident, and the medical report showed no signs of recent sexual activity or injury. The court emphasized that the purpose of medical examination is to confirm penetrative sex, not as a mere formality. The victim's testimony was obtained after being quizzed and threatened, and she was not in a distressed condition. The prosecution failed to prove its case beyond reasonable doubt, and the conviction could not stand without corroborative evidence.

Court disposition

appeal allowed; conviction quashed; sentence set aside; appellant acquitted

Orders

  • The appeal is allowed.
  • The conviction is quashed and the sentence set aside.
  • The appellant is to be released from custody unless held on other lawful charges.

Questions and positions

Legal issues

Party arguments

Applicant
Counsel for the appellant argued that there was no direct evidence to prove penetration and no independent evidence to prove that the appellant defiled the victim. The medical evidence did not show any fresh rupture of the hymen. The complainant's testimony was allegedly obtained by force, and she claimed her father told her what to say in court. Counsel contended that corroboration must come from an independent source confirming both the commission of the offence and the identity of the perpetrator.
Respondent
The Principal State Attorney supported the trial judge's evaluation, arguing that the absence of penetration could be explained by previous sexual intercourse between the victim and the appellant. He submitted that a conviction can be based on the uncorroborated evidence of the victim if the judge is satisfied with her truthfulness. The victim's report to her father was said to amount to corroboration.

05

Court’s reasoning

  1. 01

    Penal Code Act, section 129(2)

A conviction for defilement should not be based solely on uncorroborated evidence of a single witness unless the court is satisfied that the witness is truthful and reliable.

  2. 02

Trial on Indictments Act, section 66

Medical evidence is crucial in confirming whether penetrative sex occurred, especially in defilement cases.

  3. 03

    General criminal law principle

The prosecution must prove its case beyond reasonable doubt.

06

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • The fact that the victim had previous sexual encounters with the appellant was irrelevant to the charge at hand, which concerned a specific incident.
  • Medical examination is not an academic exercise; its findings must be given due weight in assessing the prosecution's case.
  • A victim's report made under threat or pressure does not amount to voluntary corroboration.

Court disposition

appeal allowed; conviction quashed; sentence set aside; appellant acquitted

  • The appeal is allowed.
  • The conviction is quashed and the sentence set aside.
  • The appellant is to be released from custody unless held on other lawful charges.
