Holding and result
The Court of Appeal found that the prosecution proved beyond reasonable doubt that the appellant participated in the robbery. The appellant's unexplained disappearance from his workplace and residence immediately after the robbery, the recovery of stolen property from his new residence, and his detailed confession provided sufficient corroboration to the identification evidence. The trial judge's evaluation of witness credibility and the circumstantial evidence were upheld. The sentence of 14 years imprisonment was within the statutory maximum and not excessive in the circumstances. The appeal was dismissed in its entirety.
Court disposition
appeal dismissed
Orders
- The conviction and sentence of 14 years imprisonment are upheld.
- The compensation order of UGX 500,000 to the complainant stands.

Questions and positions
Legal issues
- 01
Whether the offence of simple robbery was proved beyond reasonable doubt against the appellant.
- 02
Whether the trial judge erred in rejecting the appellant's defence and convicting him on allegedly unreliable, contradicting, inadequate, and uncorroborated prosecution evidence.
- 03
Whether the sentence of 14 years imprisonment and the compensation order were excessive and harsh in the circumstances.
Party arguments
- Applicant
- Counsel for the appellant argued that there was insufficient evidence to sustain a conviction for simple robbery. She submitted that although property was stolen and violence used, the appellant, who was on guard duty, was disabled by robbers and did not participate in the robbery. She contended that the trial judge wrongly ignored the appellant's defence and that even prosecution witnesses stated the appellant was not among those who entered. She challenged the recovery of stolen property from the appellant's house, arguing that its connection to him was not proved. She also argued that the confession was unreliable due to the appellant's alleged unconsciousness. On sentence, she submitted that 14 years was harsh and that the judge gave other orders without supporting reasons, praying for the appeal to be allowed and the conviction and sentence set aside.
- Respondent
- Counsel for the respondent opposed the appeal, supporting both conviction and sentence. He referred to the trial judge's reasoning on participation and identification, noting that the appellant was a guard known to witnesses and that the judge sought corroborating evidence. He argued that the appellant's disappearance from his workplace and change of residence were not acts of an innocent person. The confession was detailed and indicative of insider knowledge. He submitted that the appellant was properly identified and that the sentence was within the legal maximum, urging the court to dismiss the appeal.

Court’s reasoning
Legal principles
- 01
Moses Kasana v Uganda, Criminal Appeal No. 12 of 1981 (Supreme Court)
Where identification conditions are difficult, supportive evidence is required to corroborate the correctness of identification.
- 02
Rule 30 of the Judicature (Court of Appeal Rules) Direction; Pandya v R [1957] EA 336; Bogere Moses v Uganda, Supreme Court Criminal Appeal No. 1/1999
The appellate court must appraise all evidence adduced in the lower court and reach its own conclusion, bearing in mind it did not observe witness demeanor.
- 03
Muzaya Thomas and Mukasa George, Supreme Court Criminal Application No. 03/2006
Circumstantial evidence and confession can provide adequate corroboration for identification evidence.
06
Ratio, limits and disposition
Ratio decidendi
The Court of Appeal found that the prosecution proved beyond reasonable doubt that the appellant participated in the robbery. The appellant's unexplained disappearance from his workplace and residence immediately after the robbery, the recovery of stolen property from his new residence, and his detailed confession provided sufficient corroboration to the identification evidence. The trial judge's evaluation of witness credibility and the circumstantial evidence were upheld. The sentence of 14 years imprisonment was within the statutory maximum and not excessive in the circumstances. The appeal was dismissed in its entirety.
Obiter and limits
- The appellate court must bear in mind that it did not have the opportunity to observe witness demeanor as the trial court did.
- The conduct of the appellant after the robbery was not that of an innocent person and provided corroboration for the prosecution case.
Court disposition
appeal dismissed
- The conviction and sentence of 14 years imprisonment are upheld.
- The compensation order of UGX 500,000 to the complainant stands.
