Holding and result
The Court of Appeal found that the trial judge had properly considered all relevant factors before sentencing, including the appellant's plea of guilty, time spent on remand, first offender status, and the seriousness of the offence. The court emphasized that defilement is a strict liability offence with a maximum sentence of death, and that even if the victim appeared to have consented, this did not mitigate the gravity of the offence. The appellant's efforts at self-improvement while in prison were acknowledged but not deemed sufficient to warrant immediate release or a reduction of sentence. The appellate court concluded that there was no justification to interfere with the trial judge's exercise of discretion, and the sentence of six years imprisonment was upheld as appropriate and lawful.

Questions and positions
Legal issues
- 01
Whether the sentence of six years imprisonment for defilement was excessive in light of the mitigating circumstances presented by the appellant.
- 02
Whether the trial judge properly exercised discretion in sentencing the appellant.
Party arguments
- Applicant
- Counsel for the appellant argued that the appellant had been on remand for three years prior to sentencing, was a first offender, had shown remorse, and had reformed by pursuing education and learning skills while in prison. She requested either immediate release or a reduction of the sentence to three years.
- Respondent
- Counsel for the respondent supported the sentence, arguing that it was neither illegal nor excessive and that the trial judge had exercised proper discretion.

Court’s reasoning
Legal principles
- 01
Penal Code Act, section 129(1); general sentencing principles
Sentencing must consider both aggravating and mitigating factors, including time spent on remand, first offender status, and remorse.
- 02
Penal Code Act, section 129(1)
Defilement is a strict liability offence and the maximum sentence is death; consent of the victim is not a defence.
06
Ratio, limits and disposition
Ratio decidendi
Obiter and limits
- The appellant is supposed to learn something while in prison if he is capable of doing so; this is not a ground for immediate release.
- The law takes a serious view of defilement, and even apparent consent by the victim does not exonerate the accused.
Court disposition
appeal dismissed
- The appeal against sentence is dismissed for lack of merit.
- The sentence of six years imprisonment is upheld.
