“These Practice Directions may be cited as the Constitution (Bail Guidelines for Courts of Judicature) (Practice) Directions, 2022.”
These Practice Directions may be cited as the Constitution (Bail Guidelines for Courts of Judicature) (Practice) Directions, 2022. Practice Directions apply to all Courts of Judicature. Sets out the objectives of the Practice Directions governing bail decision-making, including ensuring compliance with the Constitution, promoting consistency in courts, balancing rights, facilitating inter-agency cooperation, reducing pretrial detention, supervising persons on bail, and promoting transparency in bail deposits and refunds. Provides definitions for terms used in the Practice Directions, including "advanced age" (sixty years and above), "applicant", "bail", "security", "surety", and "vulnerable persons". Courts must be guided by specified constitutional principles when considering bail.
