Part I

Preliminary

§ 1Preliminary - Scope of applicationProvision

Section Scope of application Section This Act shall extend to all aircraft operating in Uganda airspace, whether the aircraft is of foreign or Uganda registry, and to Uganda aircraft operating outside of Uganda territory. This Act shall not apply to State aircraft except where it is expressly stated. Notwithstanding subsection (2), in the interest of safety, all aircraft shall be subject to the safety provisions of this Act relating to the rules of the air and air traffic services.

Section 1

§ 2Preliminary - InterpretationAmendment

Provides definitions and interpretation for terms used in the Act.

Section Interpretation Section In this Act, unless the context otherwise requires— " accident " includes any fortuitous or unexpected event by which the safety of an aircraft or any person is threatened; " aerial work " means any purpose, other than public transport , for which an aircraft is flown if hire or reward is given or promised in respect of the flight or the purpose of the flight ; " aerodrome " means any definite and limited ground or water area (including any building, installation and equipment) used or intended to be used, either wholly or in part, for the arrival or departure or surface movement of aircraft ; " aircraft " includes all flying machines, aeroplanes, seaplanes, flying boats, helicopters, gliders and other aircraft designed to be heavier than air, also all airships and balloons and other aircraft designed to be lighter than air; " air navigation service " includes— (i) communication services, whether ground to air or ground to ground, provided for the safety of aircraft ; (ii) navigational services, that is to say, radio, radar and visual aids to navigation; (iii) air traffic services provided for the safety of aircraft and for the regularity of flight ; and (iv) meteorological services; " air route " means navigable airspace between two points and the terrain beneath that airspace identified, to the extent necessary, for the application of flight rules; " air transport service " means a service for the carriage by air of passengers or cargo ; " airway " means a designated path or air route identified by an area of specified width on the surface of the earth; " appeals tribunal " means a body established by section 43 to which a person aggrieved by a decision of any air transport licensing authority may appeal; " authority " means the Civil Aviation Authority established by section 3 ; " aviation security " means a combination of measures and human and material resources intended to safeguard civil aviation against acts of unlawful interference; " board " means the board of directors appointed under section 8 ; " cargo " includes goods ; " chairperson " means the chairperson of the board of directors of the authority ; " Chicago Convention " means the Convention on International Civil Aviation concluded at Chicago on 7th December, 1944, including— (i) the protocols amending that convention; (ii) the annexes to that convention relating to international standards and recommended practices, being annexes adopted in accordance with that convention; " crew " means all persons working on the aircraft , including the pilot or operator ; " flight " means— (i) in the case of a heavier-than-air aircraft , the operation of the aircraft from the moment at which the aircraft first moves under its own power for the purpose of taking off until the moment at which it comes to rest after being airborne; and (ii) in the case of a lighter-than-air aircraft , the operation of the aircraft from the moment when it becomes detached from the surface of the earth until the moment when it becomes again attached to the surface of the earth or a fixed object on the surface of the earth; " goods " includes mail and animals; " Minister " means the Minister for the time being responsible for civil aviation; " operator ", in relation to an aircraft , means the person having the management of the aircraft for the time being or, in relation to time, at the time; " owner " includes, in relation to an aircraft or aerodrome , the person in whose name the aircraft or aerodrome is registered or licensed, any person who is or has been acting as agent in Uganda for a foreign owner or any person by whom the aircraft or aerodrome is hired at the time; " passenger " means any person being conveyed by the aircraft who is not a member of the crew ; " private aerodrome " means an aerodrome other than an authority , military or police aerodrome ; " public transport " means the carriage of passengers or cargo for hire or reward given or promised to be given; " publication " means information given in any of the following publications issued whether before or after the coming into operation of this Act, that is, Notices to Airmen (NOTAM), information circulars, aeronautical information publications, notices to licensed aircraft maintenance engineers and to owners of civil aircraft , civil aviation publications (CAP) or such other official publications so issued for the purpose of enabling any of the provisions of this Act to be complied with; " state aircraft " includes— (i) aircraft of any part of the defence force, including any aircraft that is commanded by a member of that force in the course of duties; and (ii) aircraft used in the military, customs or police services of a foreign country.

Establishment, objectives, functions and powers of the authority

§ 3Establishment, objectives, functions and powers of the authority - Establishment of the authorityProvision

Establishes the Civil Aviation Authority and sets its corporate status, seal, and powers to sue and manage property.

Section Establishment of the authority Section The authority — There is established an authority by the name of the Civil Aviation Authority. shall be a body corporate with perpetual succession; shall have a seal; may sue or be sued in its corporate name; and may acquire, hold, manage and dispose of movable and immovable property.

Section 3

§ 4Establishment, objectives, functions and powers of the authority - Seal of the authorityProvision

The authority's seal must be authenticated by the managing director and the secretary to the board; the deputy managing director may sign if the managing director is absent, and the person acting as secretary may sign if the secretary is absent.

Section Seal of the authority Section The seal of the authority shall be authenticated by the signatures of the managing director and the secretary to the board . In the absence of the managing director, the deputy managing director may sign in his or her place, and the person performing the functions of the secretary may sign in the absence of the secretary. A document issued by the authority which is sealed with the seal of the authority and authenticated in the manner provided by this section shall be received and taken to be a true instrument without further proof unless the contrary is shown.

The authority’s objective is to promote the safe, regular, secure and efficient use and development of civil aviation inside and outside Uganda.

Section 5

§ 6Establishment, objectives, functions and powers of the authority - Functions of the authorityProvision

The authority must advise the Government on civil aviation policy and international aviation conventions, and is responsible for a range of functions including licensing, safety regulation, air navigation, aerodrome management, rescue, search and rescue coordination, accident investigation support, aircraft registration, personnel licensing, meteorological information, publication of regulations, and other functions conferred by the Minister or law.

Section Functions of the authority Section The authority shall advise the Government— In addition to its functions under subsection (1), the authority shall be responsible for— on policy matters concerning civil aviation generally; and with regard to international conventions relating to civil aviation and the adoption of measures necessary to give effect to the standards and recommended practices under those conventions. the licensing of air transport; the designation of domestic and international air carriers; the provision of air navigation services; the establishment, maintenance, development, operation and ownership of aerodromes; the provision of rescue and fire fighting services at aerodromes; the provision of assistance and information, including aeronautical information services; the coordination and direction of search and rescue services; the provision of facilities and services in relation to the investigation of aircraft accidents and incidents; the registration of aircraft ; the safety regulation of civil aviation; the provision, in conjunction with other agencies of the Government, including the military, of arrangements to prevent or deal with all unlawful interferences with aviation security (including passenger screening) in Uganda; the control of air traffic; the certification of operators of aircraft ; the licensing of civil aviation personnel; the licensing of private aerodromes; the provision of meteorological information to aircraft ; the publication and dissemination of all regulations pertaining to civil aviation; and any other functions that may be conferred on it by the Minister or any other law.

Section 6

§ 7Establishment, objectives, functions and powers of the authority - Powers of the authorityProvision

The authority has powers of a legal person and specific powers including entering contracts (subject to Ministerial financial limits), acquiring and disposing of assets, letting or hiring equipment, appointing advisory bodies, and may do all things necessary to carry out its functions.

Section Powers of the authority Section Without limiting the generality of subsection (1), the authority shall have power— The authority shall have all powers pertaining to a legal person and may do all things necessary for better carrying out its functions. to enter into contracts, subject to financial limitations set by the Minister ; to acquire, hold, lease out and dispose of all types of assets including land and fixed and floating assets; to let or hire plant, machinery, equipment or assets required by the authority ; and to appoint a body or bodies to advise the authority in relation to the performance of its functions.

Part III

Board of directors

§ 10Board of directors - Termination of appointmentOffence

The Minister may terminate a board member's appointment for specified causes; a board member may resign in writing with at least one month's notice to the Minister.

Section Termination of appointment Section The Minister may terminate the appointment of a member— for misbehaviour or mental incapacity; if the member becomes bankrupt; if the member becomes involved in a conflict of interest; if the member has been convicted of a criminal offence; if the member is absent from three consecutive meetings of the board or if, in any given calendar year, he or she attends less than half of the meetings of the board ; or for any other sufficient cause. A member of the board may resign his or her office in writing under his or her hand by giving not less than one month’s notice to the Minister .

Section 10

§ 11Board of directors - Functions, duties and powers of the boardProvision

The board must control and manage the authority's performance and affairs and carry out specific functions such as approving plans and reviewing senior management.

Section Functions, duties and powers of the board Section The board shall be responsible for the general control of the performance and management of the undertakings and affairs of the authority ; and without derogating from the generality of the foregoing provision, the board shall— determine the general performance of the authority ; approve business plans; determine and approve estimates of income and expenditure; review the performance of the top management officials; monitor the deployment and utilisation of the movable and immovable property of the authority ; do other things as is provided by the Act or that may be necessary for the proper implementation of the Act.

Section 11

§ 12Board of directors - Meetings of the boardProvision

The board must meet as often as necessary and at least once every three months at times and places the chairperson specifies; the proceedings are set out in the Schedule.

Section Meetings of the board Section The board shall meet for the discharge of its functions as often as is necessary; and in any case, the board shall meet at least once in every three months at a time and place specified by the chairperson . The proceedings of the meetings of the board shall be as set out in the Schedule to this Act.

Section 12

§ 13Board of directors - Remuneration of membersProvision

Members of the board and certain non-employees attending board meetings may be paid remuneration or an allowance as the Minister may determine.

Section Remuneration of members Section Members of the board and any other person not being an employee of the authority attending a meeting of the board may be paid such remuneration or allowance as the Minister may determine.

Section 13

§ 8Board of directors - Board of directorsProvision

The governing body must be a board of directors (managing director plus 4–8 directors, one a chairperson); the Minister appoints directors for three-year terms and may appoint the chair; directors are eligible for reappointment; the chairperson must notify vacancies and the Minister must fill them within three months.

Section Board of directors Section If a member of the board — The governing body of the authority shall be a board of directors consisting of the managing director and not less than four and not more than eight directors one of whom shall be the chairperson . All directors shall be appointed by the Minister for a period of three years on terms and conditions that may be specified in the instruments of appointment and shall be eligible for reappointment. The Minister shall appoint one of the directors, other than the managing director, to be chairperson of the board . dies; resigns; gets his or her appointment terminated; or ceases to hold office for any reason other than a reason under paragraph (a), (b) or (c), A member appointed under subsection (4) shall be eligible for reappointment. The chairperson shall notify the Minister as soon as a vacancy occurs in the membership of the board , and the Minister shall fill the vacancy within three months of receiving the notice.

Section 8

§ 9Board of directors - Qualifications of members of the boardProvision

The Minister must ensure at least one of the three board members is either a Ugandan citizen or a lawful permanent resident actually residing in Uganda, and must appoint persons without substantial conflicting interests to the board.

Section Qualifications of members of the board Section A person may be appointed a director— When appointing members of the board , the Minister shall ensure that at least one of the three members of the board — if he or she is a citizen of Uganda; or if he or she is lawfully admitted into Uganda for permanent residence and is actually residing in Uganda. The Minister shall appoint to the board persons without substantial conflicting interests with the board . has a recognised qualification in financial analysis; has a minimum experience of ten years at a senior position in the aviation industry; has been a legal practitioner for at least ten years.

Section 9

Part IV

Staff

§ 14Staff - Managing directorProvision

Establishes a managing director appointed by the Minister on the board's recommendation; sets appointment terms, qualifications, office term (not exceeding five years), resignation notice, restriction on outside paid employment except with Minister's written approval, and Minister's power to terminate after consulting the board with specified grounds.

Section Managing director Section The Minister may, after consultation with the board , terminate the appointment of the managing director— There shall be a managing director of the authority , who shall be appointed by the Minister on the recommendation of the board on terms and conditions that may be specified in the instrument of appointment. The managing director shall be a person with considerable knowledge and experience in aviation, administration, industry, engineering or other qualifications and experience or proven ability in other fields that the board and the Minister may consider relevant. The managing director shall be the chief executive officer of the authority and shall be responsible to the board . The managing director may not engage in paid employment outside the duties of his or her office except with the written approval of the Minister . A person appointed managing director shall hold office for a period not exceeding five years as may be specified in the instrument of appointment and shall be eligible for reappointment. for misbehaviour; for physical or mental incapacity; if the managing director becomes bankrupt; if the managing director is absent from office for a period of not less than fourteen days or for twenty-eight days in twelve months without the Minister ’s permission. The managing director may resign his or her office by giving one month’s notice in writing through the board to the Minister .

Section 14

§ 15Staff - Duties of the managing directorProvision

The managing director must, subject to board control on policy, perform listed duties including running the authority on commercial principles, planning and implementing industry development, controlling resources and operations, submitting business plans, implementing board decisions, carrying out duties devolved by the Minister or board, and keeping and consulting the board.

Section Duties of the managing director Section The managing director shall, subject to the control of the board on matters of policy, be responsible for— running the authority on sound commercial principles in accordance with policies and decisions made by the board ; planning and implementing the development of the civil aviation industry in Uganda aiming at promoting efficient, safe and reliable aviation services; controlling the resources and operations of all the services under the authority ; submitting business plans and estimates of income and expenditure to the board for its approval; implementing the decisions of the board ; carrying out any duty that may be devolved on him or her by the Minister or the board . In the performance of his or her duties, the managing director shall keep the board fully informed of the affairs of the authority and shall consult the board from time to time as may be necessary.

Section 15

§ 16Staff - Deputy managing directorProvision

Creates the office of deputy managing director, requires the deputy to assist and to act in the managing director's absence, provides for appointment by the Minister on the board's recommendation, and makes the deputy responsible to the managing director.

Section Deputy managing director Section There shall be a deputy managing director who shall assist the managing director in the performance of his or her duties and perform the duties of the managing director in the absence of the managing director. The deputy managing director shall be appointed by the Minister on the recommendation of the board and shall be responsible to the managing director.

Section 16

§ 17Staff - Corporation secretarySubstitution

Section Corporation secretary Section The corporation secretary shall be the secretary to the board and shall, in addition to any function that may be conferred upon him or her by the Minister , the board or the managing director, be responsible for— There shall be a corporation secretary who shall be appointed by the Minister on the recommendation of the board on terms and conditions that may be specified in the instrument of appointment. taking the minutes of the meetings of the board ; keeping the records of all decisions of the board ; keeping records of legal transactions of the authority ; and keeping the seal of the authority . The secretary shall, unless under exceptional circumstances the board directs in writing, giving the circumstances leading to its decision, attend all meetings of the board but shall not have a right to vote on any matter before the board . In the absence of the secretary, whether for ill health, vacancy or otherwise, the board may appoint another employee of the authority to perform the functions of the secretary until the secretary resumes office or the vacancy is filled. In the performance of his or her duties, the secretary shall be responsible to the managing director.

§ 18Staff - Other staffProvision

The authority must have other officers and supporting staff as determined by the board.

Part IX

Security and policing

§ 50Security and policing - Security regulationsProvision

The Minister may make regulations, on the authority's recommendation, requiring owners/operators and aerodrome operators to establish, maintain and carry out prescribed security measures.

Section Security regulations Section For the purposes of protecting passengers, crew members, aircraft , aerodromes and other aviation facilities, preventing unlawful interference with civil aviation and assuring that appropriate action is taken when interference occurs or is likely to occur, the Minister , on the recommendation of the authority , may make regulations— requiring any owner or operator of a Ugandan registered aircraft to establish, maintain and carry out, at aerodromes and on the aircraft and at any aviation facilities under his or her control, security measures that may be prescribed by the regulations or security measures necessary for the purpose the regulations are made; requiring any owner or operator of an aircraft registered outside Uganda that lands at or departs from aerodromes in Uganda to establish, maintain and carry out, at aerodromes and on the aircraft and at any aviation facilities under his or her control, security measures that may be prescribed by the regulations or security measures necessary for the purpose the regulations are made; and requiring any operator of a licensed aerodrome to maintain and carry out security measures at the aerodrome .

§ 51Security and policing - Passenger screeningProvision

The authority must ensure proper security screening of all passengers and cargo; no person may board an aircraft if they have not submitted to or permitted an authorised search when requested by a security officer.

Section Passenger screening Section The authority shall ensure the proper screening of all passengers and cargo for security purposes. No person shall board an aircraft who has not, when requested by a security officer, submitted to an authorised search of his or her person, or permitted an authorised search to be carried out on the goods that he or she took or had placed on board the aircraft .

§ 52Security and policing - Aerodrome securityProvision

The authority is responsible for the security of its aerodromes and related equipment, including installations located away from the aerodromes.

Policing of the authority's property is the responsibility of a special unit of a designated security force.

Financial provisions

§ 19Financial provisions - Sole shareholderProvision

The Government is the sole shareholder of the authority.

§ 20Financial provisions - Funds of the authorityProvision

The authority's funds consist of specified sources; the authority may hold bank accounts in domestic and foreign currencies; it may invest unused funds with Ministerial approval; the Government may provide appropriations for deficits and capital funding.

Section Funds of the authority Section The funds of the authority shall consist of— share capital as may be determined by the board ; grants from the Government; grants and loans from any body, organisation or person; interest on savings made by the authority ; monies that may accrue to the authority in the discharge of its functions; and money from any other source as may be approved by the Minister . The authority may possess its own bank accounts in both domestic and foreign currencies in a bank approved by the board . The authority may, with the approval of the Minister , invest any funds of the authority not immediately required for use by the board . The Government may provide appropriations to meet operating deficits and capital funding.

Section 20

§ 21Financial provisions - Commercial venturesProvision

The authority may, with a written approval of the Minister, subscribe to or purchase shares or securities of a company, join in forming a subsidiary company, or enter into a partnership.

Section Commercial ventures Section The authority may, with a written approval of the Minister — subscribe to or purchase shares, debentures or other securities of a company; join in the formation of a company that would be a subsidiary of the authority at its formation; enter into a partnership.

Section 21

§ 22Financial provisions - EstimatesCommencement

The authority must prepare and submit yearly income and expenditure estimates to the Minister within three months before the financial year; the authority may submit supplementary estimates before year-end; the Minister must notify the board within one month of a submission.

Section Estimates Section The authority shall, within three months before the commencement of each financial year, prepare and submit to the Minister for his or her approval, estimates of income and expenditure of the authority for the next ensuing year as may be approved by the board ; and at any time before the end of a financial year, the authority may prepare and submit to the Minister for approval any estimates supplementary to the estimates of a current year. The Minister shall notify the board of his or her decision on the estimates submitted to him or her within one month after the submission of the estimates. No expenditure shall be made out of the funds of the authority unless that expenditure is part of the expenditure approved by the Minister under estimates for the financial year in which that expenditure is to be made or in estimates supplementary to that year’s estimates.

Section 22

§ 23Financial provisions - Borrowing powersProvision

The authority may borrow funds (with prior Minister approval), may borrow temporarily for urgent short-term needs, may raise funds by issuing stock (with interest charged on authority assets), and loans may be government-guaranteed with finance Minister approval.

Section Borrowing powers Section For purposes of paying any loan under this section and any interest on that loan, the authority may— The authority may, with the prior approval of the Minister , borrow funds required for meeting its obligations and for carrying out its functions. The authority may borrow temporarily by way of overdraft or otherwise sums of money to be paid within a short period for any urgent requirements of the authority in the discharge of its functions. The authority may raise funds for the discharge of its functions by the issuing of stock, and any interest payable on any stock issued under this subsection shall be charged upon all property, undertaking and revenue of the authority . charge the assets, undertakings and revenue of the authority ; issue debentures and other types of bonds; do any other thing necessary to enable the authority to meet its obligations under that loan. A loan under this section may, with the approval of the Minister responsible for finance, be guaranteed by the Government. The Minister responsible for finance may, from time to time, prescribe the maximum sum that may be borrowed under this section.

Section 23

§ 24Financial provisions - Financial yearProvision

The authority's financial year runs from 1 July to 30 June of the following year.

Section Financial year Section The financial year of the authority shall be the twelve months commencing on the 1st day of July in each year and ending on the 30th day of June of the following year.

§ 25Financial provisions - Authority to operate on sound financial principlesProvision

The authority must act on sound financial principles and, as far as possible, ensure its revenue is sufficient to meet properly chargeable expenditure.

§ 26Financial provisions - AccountsProvision

The authority must prepare an annual statement of account and keep proper books and records; the statement must be prepared not later than four months after the end of the financial year.

Section Accounts Section The authority shall cause to be prepared in respect of each financial year, and not later than four months after the end of that financial year, a statement of account which shall include— The Authority shall keep proper books of account of all its income and expenditure and proper records in relation to them. a balance sheet, a statement of income and expenditure and a statement of surplus and deficit; and any other information in respect of the financial affairs of the authority as the Minister responsible for finance may require.

Section 26

§ 27Financial provisions - AuditProvision

The authority must submit its statement of account to the Auditor General within four months after the financial year; the Auditor General (or an appointed auditor) must audit within two months of receipt and deliver copies and a report to the authority and the Minister; the Auditor General has access to all financial records and is entitled to requested information.

Section Audit Section The accounts of the authority shall, in respect of each financial year, be audited by the Auditor General or an auditor appointed by him or her. The authority shall ensure that within four months after the end of the financial year the statement of account referred to in section 26 is submitted to the Auditor General for auditing. The Auditor General or any auditor appointed by him or her shall have access to all books of account, vouchers and other financial records of the authority and be entitled to have any information and explanation required by him or her in relation to those records. The Auditor General shall, within two months after receipt of the statement of account under this section, audit the accounts and deliver to the authority a copy of the audited accounts and his or her report on those accounts, stating any matter which in his or her opinion should be brought to the attention of the Minister . The Auditor General shall also deliver to the Minister a copy of the audited accounts and his or her report on those accounts.

Section 27

§ 28Financial provisions - Business plansCommencement

Section Business plans Section When preparing the business plan, the managing director shall consider— The authority shall produce a five-year business plan to be prepared by the managing director each year. The business plan shall contain financial targets and performance indicators for the authority and shall be approved by the board of directors and the Minister . the need for high standards of aviation safety; the objectives and policies of the Government known to the authority ; any directions given by the Minister ; any payments by the Government to the authority to fund its regulatory functions and search and rescue services; the need to maintain the extent of the Government’s equity in the authority ; the need to maintain a reasonable level of reserves, having regard to estimated future infrastructure requirements; the need to earn a reasonable rate of return on the authority ’s assets other than assets wholly or principally used in the performance of regulatory functions or the provision of search and rescue services; the expectation of the Government that the authority will pay a reasonable dividend; any other commercial consideration the managing director deems appropriate; and any contributions to international bodies connected with civil aviation. The business plan shall be submitted by the board of directors to the Minister at least six months prior to the commencement of the fiscal year in question, and the Minister shall make comments on the plan not later than two months after its receipt. At least six months prior to the commencement of the fiscal year in question, the authority shall provide to the Minister an estimate of the subsidy funding required to maintain operations during the coming fiscal year, which estimate shall identify specific uses to which the funds will be put, why the service is required and what actions are being taken to reduce the amount of subsidy required. A summary of the business plan shall be published by the authority after the plan has been approved by the Minister .

Section 28

§ 29Financial provisions - Charges and feesOffence

Section Charges and fees Section Without limiting the generality of subsection (1), the services and facilities that the authority may charge for include— The authority shall draw up a scheme prescribing charges and fees to be charged by the authority in respect of services or facilities provided by the authority . the issuance, renewal or variation of airworthiness certificates; inspection of aircraft ; the issuance, renewal or variation of personnel licences; aircraft landing facilities; aircraft parking facilities; air navigation and communications; fuel handling; passenger services; air operator ’s certificates; aircraft maintenance organisation approvals; accident and incident investigations; air transport licences; traffic handling; aircraft handling; and any other services related to the operation of aerodromes. The proposed scheme shall be published in an aeronautical information circular (AIC); and within thirty days after publication , it shall be submitted to the Minister for information. The scheme shall come into force on a date specified in the scheme, which shall be at least thirty days following information to the Minister . The authority may impose and revise rents and concession fees. Changes to rental and concession fees shall come into force on the days specified by the authority , which shall be at least sixty days after the revised fees and rents have been made available to the affected parties. A charge shall be payable within a period specified by the authority , and any failure to pay within the specified period may attract a penalty which shall be a percentage prescribed by the Minister per day on the outstanding charge until payment is made in full. If the total amount due is not paid within the period specified, the authority may seize the aircraft or other property after giving a reasonable notice of the intention to seize the aircraft or property to the owner or operator of the aircraft or property, and the authority shall retain the aircraft or property until payment is made in full. The amount or rate of charge shall be reasonably related to expenses incurred, or to be incurred, by the authority in relation to the provision of the service or facility.

Section 29

§ 30Financial provisions - Annual reportProvision

The authority must prepare an annual report within six months after each financial year, including an audited financial statement; the Minister must present the report to Parliament, after which it will be published.

Section Annual report Section Not later than six months after the end of each financial year, the authority shall prepare an annual report on the performance of its functions during that year which shall include, among other things, an audited financial statement. The annual report shall be presented to the Minister , who shall present it to Parliament after which it shall be published.

Section 30

§ 31Financial provisions - Consultation by the authorityProvision

The authority must consult with government, commercial, industrial, consumer and other relevant bodies when performing its functions and exercising its powers, and must establish consultative mechanisms to get users' views.

Section Consultation by the authority Section In the performance of its functions and exercise of its powers, the authority shall, where appropriate, consult with the Government, commercial, industrial, consumer and other relevant bodies and organisations. The authority shall establish whatever consultative mechanisms it deems necessary to secure the views of the users of the authority ’s facilities and services.

Part VI

Civil aviation

§ 32Civil aviation - Chicago Convention and other agreementsAmendment

The authority must carry out its functions consistent with the Chicago Convention and related international civil aviation agreements, and must perform obligations under agreements between Uganda and other states or organisations concerning air navigation safety, security, regularity and efficiency.

Section Chicago Convention and other agreements Section The authority shall be responsible for carrying out its functions in a manner consistent with the Chicago Convention , any annex to the convention relating to international standards and recommended practices and any amendment made in accordance with the convention or other international conventions relating to civil aviation. It shall be the responsibility of the authority to perform any obligations required by an agreement between Uganda and any other country or intergovernmental organisation with respect to the safety, security, regularity and efficiency of air navigation.

Section 32

§ 33Civil aviation - Air navigation servicesOffence

The Minister, on recommendation of the authority, may make regulations to ensure the safe, regular, orderly and expeditious flow of air traffic and may make regulations and impose penalties on specified matters; the authority shall provide air navigation services in Uganda airspace and for areas Uganda has undertaken to provide such services, and a person licensed to operate a private aerodrome may be authorised to provide air navigation services for that aerodrome.

Section Air navigation services Section The Minister , on recommendation of the authority , may make regulations to ensure the safe, regular, orderly and expeditious flow of air traffic and, without limiting the generality of the foregoing provision, the Minister , on the recommendation of the authority , may make regulations and impose penalties pertaining to— The authority shall provide air navigation services in Uganda airspace and for any area outside of Uganda for which Uganda has, in pursuance of international arrangements, undertaken to provide air navigation services and to direct and coordinate search and rescue services therein. Where a person or body is licensed to operate a private aerodrome , he or she may be authorised to provide air navigation services for the use of the aerodrome . air traffic control procedures and services; the provision of navigation aids; standards for navigation aids; requirements for equipment to be carried on aircraft ; the conditions under which aircraft may be used or operated or under which any act may be performed in or from aircraft ; the aerodromes at which aircraft coming from outside Uganda are to land and the conditions to which such aircraft are subject; the classification and use of airspace and the control and use of air routes; the control of the operation of aircraft within or directly above the aerodrome for the purposes of limiting or mitigating the effect of noise, vibration or atmospheric pollution caused by aircraft using the aerodrome ; and rules of the air.

Section 33

§ 34Civil aviation - Air regulationsProvision

The Minister may make regulations (on the recommendation of the authority) covering many civil aviation topics; the authority must set and maintain safety standards meeting international criteria.

Section Air regulations Section The Minister , on the recommendation of the authority , may make regulations pertaining to— The authority shall set and maintain safety standards related to personnel, aircraft and aerodromes, which meet international criteria. the licensing of flight crew members, air traffic controllers and operators of equipment used to provide services relating to civil aviation; the licensing of persons engaged in the design, manufacture, distribution, maintenance, approval, certification or installation of aeronautical products; the installation, maintenance, approval and certification of equipment used to provide services relating to civil aviation; activities at aerodromes and the location of aerodromes; noise emanating from aerodromes and aircraft ; the conditions under which persons or personal belongings, baggage, goods or cargo of any kind may be transported by aircraft ; the keeping and preservation of records and documents relating to aerodromes, persons holding Uganda civil aviation documents, and equipment and facilities used to provide services relating to civil aviation; the handling, marking, storage and delivery of fuel and any lubricants or chemicals used during or in connection with the operation of aircraft ; the inspection and licensing of aircraft ; the airworthiness of aircraft ; transport of dangerous goods , ammunition and munitions of war; and any other area deemed necessary by the authority to ensure the safety of civil aviation.

Section 34

§ 35Civil aviation - Aeronautical Information ServiceProvision

The authority must provide an Aeronautical Information Service, publish an AIP and NOTAMs, forward those publications to ICAO, and may publish other aviation circulars.

Section Aeronautical Information Service Section The authority shall provide a service to be known as the Aeronautical Information Service, which shall comprise the collection and dissemination of aeronautical information and instructions with respect to— In providing the Aeronautical Information Service, the authority shall publish the Uganda aeronautical information publication (AIP) which shall include— The authority shall, in addition to the AIP, publish Notices to Airmen (NOTAM) which shall include— aerodromes; air traffic control services and facilities; communication and air navigation services and facilities; meteorological services and facilities; search and rescue services and facilities; procedures and regulatory requirements connected with air navigation; hazards to air navigation; differences from International Civil Aviation Organisation standards, recommended practices and procedures; units of measurement; nationality and registration marks; special equipment to be carried on aircraft ; bird concentrations on or in the vicinity of aerodromes; prohibited or restricted airspace and danger areas; minimum flight altitudes; fees and charges; and aeronautical charts. the aeronautical information and instructions that are by this Act required to be so published; such other aeronautical information and instructions as are of a lasting character essential to air navigation; and any matter relating to the facilitation of air traffic. the aeronautical information and instructions that may by this Act be required to be published; and such other aeronautical information and instructions as are of a temporary character or cannot be made available quickly enough by publication in the aeronautical information publication . The authority shall forward copies of the aeronautical information publication and Notices to Airmen (Class Two) to the International Civil Aviation Organisation. The authority may also publish information on various aviation topics such as licensing, maintenance or any other item as Uganda civil aviation publications (UCAP), aeronautical information circulars (AICs) and airworthiness circulars. Unless a document of the authority states explicitly that it is of an advisory or guidance nature, publications identified in this section shall have legal authority .

Section 35

§ 36Civil aviation - Technical servicesProvision

The authority must provide technical services for air navigation and communications equipment; it may contract these out provided safety of air transport is not compromised.

Section Technical services Section The authority shall provide technical services for the design, installation, maintenance and modification of electronic, radio and other equipment used in the provision of air navigation and communications service. The authority may contract out for any of these services to other Government departments or private sector firms so long as this does not compromise the safety of air transport.

Section 36

§ 37Civil aviation - Meteorological servicesProvision

The authority must provide specified aviation meteorological services in Uganda; the department of meteorology must provide appropriate aviation meteorological services to the authority.

Section Meteorological services Section The authority shall provide specified aviation meteorological services in Uganda, and information concerning weather conditions and forecasts shall be provided to all aircraft in Ugandan airspace in a timely and orderly fashion. Appropriate aviation meteorological services shall be provided to the authority by the department of meteorology. The basis on which meteorological services will be provided to the authority shall be determined by mutual agreement between the department of meteorology and the authority .

Section 37

§ 38Civil aviation - Investigation of occurrencesOffence

Minister may investigate occurrences; Minister must appoint chief inspector and inspectors; chief inspector and inspectors have entry and investigative rights; obstructing an investigation is an offence with a penalty that may be prescribed by the Minister.

Section Investigation of occurrences Section The chief inspector of accidents— The Minister may investigate and review the circumstances surrounding all accidents and incidents and occurrences. The Minister shall appoint a chief inspector of accidents and inspectors of accidents to investigate and review all accidents. shall report directly to the Minister ; may utilise the resources of the authority during the investigations. The chief inspector of accidents and inspectors of accidents shall have the right of entry at all accident sites to investigate and inspect accidents, retrieve flight recorders and other materials or information pertinent to the accident , including aircraft parts or material on the ground hit by the aircraft , and may examine any other records or documents related to the occurrence, such as flight log books, maintenance records and personnel records. An inspector of accidents shall be a person properly trained in investigating aircraft accidents. A person obstructing an investigation made under this section commits an offence and is liable on conviction to a penalty that may be prescribed by the Minister .

Section 38

§ 39Civil aviation - Assessment and inspectorsProvision

The Minister may assess aviation navigational facilities, services, aerodromes and technical personnel; may appoint inspectors; inspectors are entitled (with permission) to access facilities and records while on duty; and the Minister may, on inspectors' advice, take action to ensure standards.

Section Assessment and inspectors Section The Minister may, from time to time, assess the standards of navigational facilities and services and aerodromes and technical personnel manning the facilities and providing the services to ensure that they meet the standards required. The Minister may appoint inspectors to carry out the assessment referred to under subsection (1). The inspectors shall, with the permission of the person in charge, have access to aerodromes, related facilities and installations, navigation and communication facilities and to any records, information and explanation that may be required in the course of their duty. The Minister may, on the advice of any inspector take appropriate action to ensure the appropriate standards.

Part VII

Air transport and international obligations

§ 40Air transport and international obligations - International obligationsProvision

The aeronautical authority of Uganda is the Minister responsible for civil aviation; that authority must comply with international civil aviation agreements, must advise and assist the Government in international air services negotiations and dealings with international aviation bodies; the Minister may delegate some powers to the Civil Aviation Authority.

Section International obligations Section The aeronautical authority of Uganda shall be the Minister responsible for civil aviation who may delegate some of his or her powers to the Civil Aviation Authority in accordance with this Act. The authority shall comply with all international agreements pertaining to civil aviation signed by the Government. The authority shall advise and assist the Government in its negotiations with other countries in regard to international air services originating, transiting or terminating at Ugandan aerodromes and those overflying Uganda. The authority shall act as adviser to the Government and assist in its dealings with the International Civil Aviation Organisation (ICAO), the African Civil Aviation Commission (AFCAC), the Commonwealth Air Transport Council (CATC) and other similar international civil aviation bodies.

Section 40

§ 41Air transport and international obligations - Authority’s permission and establishment of fares, etc.Provision

Aircraft are prohibited from arriving from, departing to, or overflying Uganda; the Minister may establish fares and freight rates on the advice of the authority.

Section Authority’s permission and establishment of fares, etc. Section No aircraft shall— arrive in Uganda from a place outside Uganda; depart from Uganda for a place outside Uganda; or overfly Uganda, The Minister may, on the advice of the authority , establish fares, freight rates and related matters.

Section 41

§ 42Air transport and international obligations - Air operators certificateProvision

The authority may issue air operators certificates and may impose or vary conditions; it prescribes required application information and must respond to applications within 90 days, giving written reasons if rejected.

Section Air operators certificate Section Without limiting the generality of subsection (1), the authority may impose conditions relating to— The authority may issue an air operators certificate with or without any conditions attached; and where any conditions are attached to a certificate, the authority may vary or impose further conditions as it may deem appropriate. A certificate issued under subsection (1) shall not be transferable without the consent of the authority . airworthiness; capability of the flight crew ; maintenance capability of the aircraft operating company; management capability of the aircraft operating company; financial viability of the aircraft operating company; traffic demand of proposed route; and ability of existing aircraft operators to meet this demand. An application for an air operators certificate shall be made in writing to the authority and shall contain information that shall be prescribed by the authority . The authority shall respond to an application for an air operators certificate within 90 days of its receipt and shall provide written reason for its decision if the application is rejected.

Section 42

§ 43Air transport and international obligations - Appeals tribunalProvision

Establishes an appeals tribunal as a judicial body to determine appeals from authority licensing decisions; the Minister must make regulations on its composition and procedure on the board's recommendation.

Section Appeals tribunal Section There shall be established an appeals tribunal which shall be a judicial body for the determination of appeals from decisions of the authority relating to licensing under this Act. The Minister , on the recommendation of the board , shall make regulations regarding the composition and procedure of the appeals tribunal .

Section 43

§ 44Air transport and international obligations - Appeal to appeals tribunalProvision

A person aggrieved by a licensing decision of the authority may appeal to the appeals tribunal on matters of law.

Section Appeal to appeals tribunal Section A person aggrieved by a decision of the authority relating to licensing under this Act may appeal to the appeals tribunal on matters of law.

Section 44

Part VIII

Aerodromes

§ 45Aerodromes - Establishment of aerodromesProvision

Section Establishment of aerodromes Section The Minister , on the recommendation of the authority , may make regulations necessary to ensure adequate facilities for consultation with— Without limiting the generality of subsection (3), the Minister may make regulations— The authority may establish and maintain aerodromes and provide and maintain in connection with them roads, approaches, apparatus, equipment, buildings and other accommodations. the local authorities in whose areas the aerodrome or any part of the aerodrome is situated; other local authorities whose areas are in the neighbourhood of the aerodrome ; and other organisations representing the interests of persons concerned with the locality in which the aerodrome is situated. The Minister , on the recommendation of the authority , may make regulations necessary for regulating the use and operation of aerodromes and the conduct of all persons while within aerodromes. for securing the safety of aircraft , vehicles and persons using the aerodrome and preventing danger to the public arising from the use and operation of the aerodrome ; for preventing obstruction within the aerodrome ; for regulating vehicular traffic anywhere within the aerodrome , including speed restrictions and parking limitations; for prohibiting or restricting access of persons, vehicles or animals to any part of the aerodrome ; for preserving good order and conduct within the aerodrome and preventing damage to property; for requiring any person, if so requested by a police officer or aerodrome official, to leave the aerodrome or to state his or her name and address and the purpose of his or her presence on the aerodrome ; for disposing of unclaimed property in or upon the aerodrome ; and for controlling the disposal of waste, international garbage and spilled fuel.

Section 45

§ 46Aerodromes - Zoning and land use controlProvision

The Minister may, on the authority's recommendation, by order impose prohibitions or restrictions on land or water near aerodromes and may give directions; the authority must publish notice before imposing prohibitions, and may require stopping or diversion of highways; the Minister must publish proposed zoning regulations in specified publications.

Section Zoning and land use control Section The Minister , on the recommendations of the authority , may by order impose prohibitions or restrictions on the use of any area of land or water in the vicinity of an aerodrome as may be necessary to ensure safe and efficient civil aviation; and without limiting the generality of the foregoing, the Minister may give directions— for requiring the total or partial demolition of any building or structure in the vicinity of the aerodromes; for restricting the height of trees and other natural and man-made structures upon any land within the vicinity of an aerodrome ; for extinguishing any private right of way over land within the vicinity of an aerodrome ; for restricting the installation of cables, mains, pipes, wires or other apparatus upon, across, under or over any land within the vicinity of an aerodrome ; for restricting the use of certain electronics within the vicinity of an aerodrome . Before any prohibition or restriction is imposed, the authority shall make a public notice of its intention to impose the restriction or prohibition in the area. If deemed necessary for the safe and efficient use of civil aviation, the authority may require the stopping or diversion of any highway. The Minister shall cause notice of every zoning regulation that is proposed to be made to be published in two successive issues of at least one local newspaper, if any, serving the area to which the proposed zoning regulation relates and in two successive issues of the Gazette . Reasonable opportunity shall be afforded to interested persons to make representations to the Minister with respect to zoning regulations, before the regulations are actually made.

Section 46

Unauthorised entry into secured areas of aerodromes (such as runways, aprons and passenger holding areas) is prohibited.

Suitable facilities must be made available at Uganda aerodromes for customs, immigration and health; those services are the responsibility of other Government authorities and agencies, and the authority together with the relevant Government authority or agency determine the terms and conditions for making facilities available.

Section Customs, immigration and health Section Suitable facilities will be made available to relevant Government authorities and agencies at Uganda aerodromes whenever necessary, for the provision of customs, immigration and health services. The provision of customs, immigration and health services is not the responsibility of the authority but of other Government authorities and agencies concerned. The terms and conditions under which suitable facilities shall be made available to Government authorities and agencies will be determined by the authority and the Government authority or agency in question.

Section 48

§ 49Aerodromes - LiabilityProvision

Aerodromes and licensed aerodromes must be made available for use by civil aircraft, provided that use is entirely at the risk of the aircraft's registered owner; neither the authority, the licensee nor the Government will be held responsible for loss or damage caused by specified events beyond their control.

Section Liability Section Authority aerodromes and other licensed aerodromes shall be made available for use by civil aircraft on the expressed condition that the use is entirely at the risk of the registered owner of the aircraft concerned and that neither the authority , the licensee nor the Government shall be held responsible for loss or damage resulting from the use of the authority or licensed aerodromes or their accessory facilities through an act of God, war, civil commotion, riot, looting or any other cause beyond the control of the authority or licensee.

Part X

Miscellaneous provisions

§ 55Miscellaneous provisions - Directions by the MinisterProvision

The Minister may give the authority written directions about how to perform its functions, but those directions must be only of a general nature.

Section Directions by the Minister Section The Minister may give the authority written directions as to the performance of its functions, which directions shall be only of a general nature. Particulars of any directions given in a financial year shall be included in the annual report of the authority for the year.

Section 55

§ 56Miscellaneous provisions - Delegation by the MinisterProvision

The Minister may delegate any responsibilities conferred on them by the Act to the authority.

§ 57Miscellaneous provisions - Personnel managementProvision

The authority must pay determined benefits to its employees (excluding certain senior officers), have those benefits approved by the Minister, and train its employees to acceptable standards and competency.

Section Personnel management Section The authority shall, in the case of its employees other than the managing director, deputy managing director and corporation secretary pay wages, salaries, pensions, allowances and any other pecuniary or nonpecuniary benefit as it determines to be necessary, and the benefits shall be approved by the Minister . The authority shall train its employees to the acceptable standards and competency for the performance of their duties.

Section 57

§ 58Miscellaneous provisions - Nuisance and liability for damageProvision

Overflight in accordance with regulations is not trespass or nuisance; material loss or damage from aircraft (including falling persons or articles) is recoverable from the operator or owner unless caused or contributed to by the victim's negligence.

Section Nuisance and liability for damage Section The mere overflight of an aircraft over a property at a height above the ground in accordance with authority regulations made under this Act shall not be considered trespass or nuisance. Material loss or damage caused to any person or property on land or water by a person in, or an article or person falling from, an aircraft in flight , taking off or landing shall be recoverable from the operator or owner of the aircraft , unless the loss or damage was caused or contributed to by the negligence of the person who experienced the loss or damage.

Section 58

§ 59Miscellaneous provisions - Company, etc. not to contravene the ActProvision

Companies or partnerships in which the authority may have an interest must not do anything prohibited by or that contravenes this Act.

Section 59

§ 60Miscellaneous provisions - Actions of the authority not invalidProvision

Actions taken by the authority shall not be invalid solely because they are contrary to the Act or inconsistent with its functions; this includes transfers or acquisitions of property by the authority.

Section 60

The Minister may, on the recommendation of the authority, make regulations across a wide range of aviation matters including licensing, fares, designation of carriers, air navigation, routes and facilities, personnel matters, accident investigation, security, registration, airworthiness, certification, cargo conditions, meteorological services, aircraft design and maintenance, publications, land acquisition, and penalties or prosecutions.

Section General regulations Section Without limiting the generality of subsection (1), the Minister may, on the recommendation of the authority , make regulations relating to— The Minister may make regulations generally for the better performance by the authority of its functions. the licensing of air transport and the prescribing of fares, tariffs, rates and charges under this Act; the designation of domestic and international air carriers; the provision of air navigation services; the planning, establishment, maintenance, operation and use of air routes, airway facilities, aeronautical information services and search and rescue and prohibiting or restricting aircraft from flying over certain areas in Uganda; the personnel engaged in matters referred to in paragraph (d); investigation of aircraft accidents and incidents; the security of aerodromes, aircraft and passengers; registration and marking of aircraft ; airworthiness; certification and licensing of air operators; conditions under which certain kinds of cargo may be carried; the flight crews engaged in the operation of aircraft ; provision of meteorological services for air navigation; the design, construction, repair, overhaul, maintenance, operation and use of aircraft and related equipment; the personnel engaged in matters referred to in paragraph (n); publications and dissemination of all regulations; the acquisition or expropriation of land under the relevant laws, for the better performance of the functions of the authority ; and the imposition of penalties or prosecution of those persons who contravene the regulations. The Minister may, under regulations made under this Act, prescribe higher penalties, not being unreasonable, than penalties which can be prescribed by regulations under the Interpretation Act.

§ 62Miscellaneous provisions - Power to take actionProvision

The authority is empowered to take legal measures necessary to ensure implementation of and compliance with regulations made under the Act.

§ 63Miscellaneous provisions - ExemptionProvision

The Minister may exempt any person, aircraft, aerodrome facility or service from regulations if the exemption is in the public interest and is not likely to affect aviation safety; exemptions are to be published in the Gazette.

Section Exemption Section Notwithstanding section 41 , the Minister may, on terms and conditions that may be necessary, exempt any person, aircraft , aerodrome facility or service from application of any regulations made under this Act, if the exemption is in the public interest and is not likely to affect aviation safety. Any exemption granted under this section shall be published in the Gazette .

§ 64Miscellaneous provisions - War and emergenciesProvision

When there is war or a great national emergency the Government must proclaim it, and the Minister may by order require property to be placed at the Minister’s disposal, regulate or prohibit navigation of aircraft over Uganda, and take possession of aerodromes, aircraft and related items for the Government’s military forces.

Section War and emergencies Section In time of war, whether actual or imminent, or of great national emergency, the Government shall proclaim the existence of such a state of affairs and then the Minister — In time of war, whether actual or imminent, or of great national emergency, the Minister may by order require the following to be placed at the disposal of the Minister — may by order regulate or prohibit, either absolutely or subject to conditions that may be contained in the order, the navigation of all aircraft over Uganda; and may by order provide for taking possession of and using for the purposes of the Government’s military forces any aerodromes, or any aircraft , machinery, plant, material or things found therewith, and for regulating or prohibiting the use, erection, building, maintenance or establishment of any aerodrome or flying school. all or any of the property or rights of, or under the control of, the authority ; the whole or any part of the relevant undertaking of any Ugandan air transport business; and all or any property or rights of or under the control of any businesses which appertain to the undertaking under paragraph (b).

The Government must provide at the outset grants or loan funds to meet the working capital needs of the authority and may set the appropriate interest rate on those funds if necessary.

Section Saving Section Regulations pertaining to the control and governance of civil aviation established by the Government prior to this Act shall remain in force until such time as the Minister or the authority on behalf of the Minister makes new regulations.
