Purpose and legislative effect

“Defines "armorial ensigns" and "national flag" for the Act.”

Defines "armorial ensigns" and "national flag" for the Act. Declares the design in Part I of the Schedule to be the National Flag of Uganda and the blazon in Part II of the Schedule to be the Armorial Ensigns of Uganda. It is an offence for any person to, with intent to bring into contempt or ridicule, do any act or utter any words or publish any writing about the national flag or armorial ensigns (or representations); conviction may lead to imprisonment up to two years; Minister may order deportation of non‑citizens convicted. No person may, without the authority of the Minister, use or allow the use of the national flag or armorial ensigns (or closely resembling devices) in connection with a business, trade, calling or profession; contravention is an offence punishable by a fine up to one thousand shillings or imprisonment up to six months or both. The Minister has the power to make regulations regarding display and use of the national flag and armorial ensigns, and to regulate related licence applications and fees.

Section Interpretation Section In this Act— " armorial ensigns " means the Armorial Ensigns of Uganda; " national flag " means the National Flag of Uganda.

§ 2Declaration of the national flag and armorial ensignsProvision

Declares the design in Part I of the Schedule to be the National Flag of Uganda and the blazon in Part II of the Schedule to be the Armorial Ensigns of Uganda.

Section Declaration of the national flag and armorial ensigns Section The flag of which the design is set out in Part I of the Schedule to this Act is declared to be the National Flag of Uganda. The heraldic device of which the blazon is set out in Part II of the Schedule to this Act is declared to be the Armorial Ensigns of Uganda.

Section 2

§ 3Insulting the national flag or armorial ensignsOffence

Section Insulting the national flag or armorial ensigns Section Any person who does any act or utters any words or publishes any writing with intent to bring into contempt or ridicule the national flag or armorial ensigns or any representation thereof commits an offence and is liable on conviction to imprisonment for a period not exceeding two years. Where a person convicted of an offence under subsection (1) is not a citizen of Uganda, the Minister may make an order directing that the person be deported from and remain out of Uganda, either indefinitely or for a time to be specified in the order. An order made under subsection (2) shall be deemed to be an order made under section 17 of the Immigration Act and may be enforced and otherwise dealt with accordingly.

§ 4Unauthorised use of the national flag or armorial ensignsOffence

Section Unauthorised use of the national flag or armorial ensigns Section No person shall, without the authority of the Minister, use or permit to be used in connection with any business, trade, calling or profession the national flag or the armorial ensigns , or a flag or device so nearly resembling them as to be calculated to deceive, in a manner calculated to lead to the belief that he or she is duly authorised to use the national flag or armorial ensigns , as the case may be, in that connection. Any person who contravenes this section commits an offence and is liable on conviction to a fine not exceeding one thousand shillings or to imprisonment for a period not exceeding six months or to both such fine and imprisonment.

§ 5RegulationsProvision

The Minister has the power to make regulations regarding display and use of the national flag and armorial ensigns, and to regulate related licence applications and fees.

Section Regulations Section The Minister may make regulations— prescribing the occasions upon which, the persons by whom and the manner in which the national flag or the armorial ensigns may be flown or displayed, as the case may be; prohibiting, controlling or restricting the use of the national flag or armorial ensigns ; and regulating the manner in which applications may be made to him or her for his or her authority to use the national flag or armorial ensigns in the connection mentioned in section 4 , prescribing a form of licence by which that authority may be given and fixing fees for the applications and licences.
