Cumming v Hotel (C.A. 28/1934.) [1935] EACA 25 (1 January 1935)

The Court of Appeal held that the appellant's conduct in leaving substantial sums of money in easily accessible locations within his hotel room, without informing hotel staff or taking reasonable precautions, constituted imprudence and lack of ordinary care. The court found that the losses would not have occurred had the appellant exercised the degree of care that a prudent person would reasonably be expected to exercise under the circumstances.
