Wasula v Uganda (Criminal Revision 3 of 2023) [2024] UGHC 465 (10 June 2024)
The court held that there is no legal basis for staying criminal proceedings merely because a civil suit involving the same facts is pending between the parties. The Supreme Court precedent in Kulata Basangwa v Uganda [2018] UGSC 55 establishes that both criminal and civil proceedings can proceed simultaneously, even if they arise from the same facts. The Director of Public Prosecutions has constitutional authority to institute criminal proceedings independently of any civil matters.
