Nalwoga v Edco Limited & 2 Ors (Revision Cause No. 05 of 2012) [2012] UGHC 261 (29 November 2012)

The court found that the applicant's supporting affidavit contained falsehoods regarding her alleged physical possession of the suit land, which was rebutted by the respondents' affidavits and not adequately countered by the applicant. The presence of falsehoods rendered the entire affidavit suspect, and in accordance with established legal principles, an application supported by a false affidavit cannot stand. Without a valid supporting affidavit, the notice of motion was left unsupported and could not be sustained. Consequently, the application was dismissed with costs.
