The court held that although the Labour Disputes (Arbitration and Settlement) Act 2006 envisages complaints being lodged with the Labour Officer before referral to the Industrial Court, the claimant was justified in filing the suit in the High Court at the time because the Industrial Court was not operational. The High Court has unlimited original jurisdiction, and the subsequent referral to the Industrial Court was valid.
