The Supreme Court held that it is impermissible for counsel representing multiple parties to file separate bills of costs unless separate proceedings were taken and justified. The taxing officer erred in law by allowing two bills of costs and double awards of fees. The assessment of instruction fees was manifestly excessive and based on an incorrect principle, as the monetary value of the subject matter was not an issue before the Supreme Court.
