The High Court found that the Chief Magistrate of Pallisa acted without jurisdiction in transferring Civil Suit No. 36 of 2020 to Budaka Chief Magistrates Court. Jurisdiction is strictly statutory, and the suit property was situated in Budaka district, which had its own Chief Magistrates Court established in 2017. The law only empowers the High Court, not subordinate courts, to transfer suits, and only if the suit was initially filed in a court with proper jurisdiction.
