The Supreme Court held that the application for leave to file an appeal out of time was properly before it. The Court reasoned that the Notice of Appeal filed on 18/7/95 commenced legal proceedings before the promulgation of the 1995 Constitution. Article 280 of the Constitution and Section 9 of Statute 12/1996 were intended to save such pending proceedings, allowing them to be continued and completed by the Court as then composed.
