The contract between the Plaintiff and Defendant was void ab initio due to a common mistake regarding the Plaintiff's eligibility for admission to a Bachelor's degree programme. Both parties erroneously believed the Plaintiff qualified for admission, but the NCHE found his West African Senior School Certificate was only equivalent to UCE, not UACE, and thus insufficient for direct entry.
