The court found that the Ministry of Trade, Industry and Co-operatives (MTIC) failed to perform its statutory duty by not constituting the Uganda Sugar Board (USB) as required under the Sugar Act. The USB is the sole authority empowered to grant sugar and jaggery mill licences. The permissions and 'letters of no objection' (LONOs) issued by MTIC and the Uganda Investment Authority (UIA) to CN Sugar Limited and Shakti Sugar Limited were ultra vires, illegal, and of no legal effect.
