The court held that the claimant was not entitled to salary or benefits for the period he was incarcerated, as he did not render any service to the government during that time. The conviction and sentence were imposed by competent courts, and the subsequent acquittal did not retroactively entitle the claimant to salary for the period of lawful incarceration. Section 41(5) of the Employment Act and the Public Service Standing Orders clearly prohibit payment of salary during imprisonment.
