The court found that the Plaintiff's objection based on Regulations 9 and 10 of the Advocates (Professional Conduct) Regulations was not made out, as there was no fiduciary relationship between the Plaintiff and M/S Ligomarc Advocates, and the regulation concerning advocates acting as witnesses applies to individuals, not the entire firm. However, the court held that the real issue was the impropriety of a law firm acting as both party/litigant (through its appointment as Caretaker Manager and nomination of partners as agents) and advocate in the same contentious matter.
