The court found that the respondent did not seize the applicant's property but only exercised his contractual right to inspect the premises before the applicant vacated, as stipulated in the tenancy agreement. The dispute was contractual, not a matter of constitutional rights infringement. Consequently, the applicant was not entitled to the remedies sought.
