Kato v Oging (Civil Suit 260 of 2017) [2023] UGHCLD 244 (17 August 2023)
The plaintiff established lawful acquisition of the Kibanja by purchase from Hajji Hassan Bulwadda with the consent of the registered owner, Hassan Walubi Bulwadda, as required by section 34 of the Land Act. Oral and documentary evidence confirmed the owner's consent and the location of the Kibanja. The defendant failed to prove lawful acquisition, as his purchase agreement lacked evidence of the registered owner's consent and did not specify the suit land's particulars.
