The Court held that it lacks jurisdiction to hear and determine the Application brought by Atabong Denis Atemnkeng against the African Union. The Protocol establishing the African Court on Human and Peoples' Rights restricts the Court's jurisdiction to cases brought against State Parties that have ratified the Protocol and made a declaration under Article 34(6) accepting the Court's competence to receive cases from individuals and NGOs. The African Union, as a non-State entity and not a party to the Protocol or the Charter, falls outside the scope of the Court's jurisdiction ratione personae.…
