The court exercised its discretion under the Civil Procedure Rules to allow the late filing of the 4th Defence witness statement. The witness, Mr. Hatanga, was named in the Defence pleadings from the outset and is not an additional witness. No prejudice was shown that would be occasioned to the Plaintiff by the late filing, and the Plaintiff is granted liberty to recall her witnesses to respond to any new matters arising from Mr. Hatanga's testimony.
