Kijjambu v Uganda (Criminal Appeal 9 of 2022) [2023] UGHCCRD 35 (14 June 2023)
The court found that the appellant's actions went beyond defence of property. The evidence showed that after subduing the complainant, the appellant repeatedly assaulted him with a panga, including a final blow to the head as the complainant was fleeing. The use of a deadly weapon on a vulnerable part of the body, and the lack of any immediate threat to the appellant, demonstrated an intention to cause death.
