Omara v The Board of Governors Management Committee Kotido Mixed Primary School (HCT-04-CV-CS-0023 of 2002) [2005] UGHCCD 2 (14 July 2005)
The court found that the deceased, Florence Achieng, was a boarding pupil at the defendant school and died by drowning after leaving the school premises with other pupils. The defendant school failed to file a defence or controvert the plaintiff's evidence, which was therefore taken as admitted. The school owed a duty of care to its pupils, especially young boarding students, to supervise them and prevent unauthorized excursions.
