Tugumisirize v Zinabweine (Civil Appeal No. 16 of 2002) [2003] UGCA 29 (19 December 2003)

The Court of Appeal found that the trial judge exercised her discretion judiciously in refusing further adjournments and closing the defence case after repeated absences and lack of diligence by the appellant and her counsel. The judge did not rely on oral information from opposing counsel but on the conduct and repeated nonattendance of the appellant, who had been given ample opportunity to present her case.
