The court found that, although the memorandum of appeal was filed approximately two months after the judgment, the intervening period was attributable to the time taken by the court to certify the proceedings. Section 79(2) of the Civil Procedure Act mandates exclusion of such time from the computation of the limitation period. Since there was no evidence indicating when the certified proceedings were delivered, and the record did not specify the date of certification, the court presumed the appeal was filed promptly upon receipt of the proceedings.
