The Court of Appeal found that the circumstantial evidence relied upon by the trial judge was insufficient to prove the appellant's guilt beyond reasonable doubt. The chain of evidence was weakened by the absence of medical evidence as to the cause of death and the failure to prove that the axe recovered from the appellant's house was the murder weapon. The confession statement was wrongly admitted, as the proper procedure for a trial within a trial was not followed and the magistrate was not called to prove voluntariness.
