The court found that no contract existed between the plaintiff and the defendant because the electricity account was opened by Rhoda Wanyana before the plaintiff company was incorporated, and there was no evidence of assignment or novation of the contract to the plaintiff. However, the court held that the absence of a contractual relationship did not preclude a claim in negligence.
