Abbes v Tunisian Republic (Application No. 026/2028) [2022] AfCHPR 64 (23 June 2022)

The Court found that the applicant repeatedly failed to comply with requests to submit supporting documents and to respond to the respondent's submissions, despite multiple reminders and extensions. The Court determined that the applicant's inaction demonstrated a lack of due diligence in pursuing the application. As a result, under Rule 65(1)(b) of the Rules of Court, the Court exercised its discretion to strike out the application from its cause list. The decision was made without prejudice to the applicant's right to file a new application in accordance with the Rules.
