The court found that the defendant did not lawfully terminate the plaintiff's employment. Although the employer has the right to terminate employment, this must be done in accordance with the contract and personnel regulations. The plaintiff's contract required one month's notice or salary in lieu of notice for normal termination, and allowed summary dismissal only in cases of proven misconduct.
