Nsubuga v Nakiganda & 2 Others

Nsubuga v Nakiganda & 2 Others (CIVIL APPEAL NO. 154 OF 2016) [2020] UGHCCD 24 (26 March 2020)

The court found that the appellant had defaulted on rent payments, resulting in the lapse of the tenancy agreement prior to the sale of the premises. There was no mutual agreement among all parties to discharge the original contract and substitute a new one, thus the doctrine of novation did not apply.
