The Tribunal correctly found that the procurement process and contract award to the second Respondent were tainted by material deviations from the evaluation criteria and statutory requirements. The second Respondent did not meet the mandatory experience requirements, and the contract was signed during the administrative review period in violation of section 90(7) of the PPDA Act. These acts constituted fatal illegalities, rendering the contract a nullity.
