Nyamutale v Nabitaka & Ors (Civil Suit No. 900 of 2000) [2001] UGHC 16 (11 June 2001)

The court found that the plaint disclosed sufficient material to meet the prerequisites for causes of action in respect of malicious falsehood and conspiracy to injure in trade. However, upon applying the test for res judicata, the court determined that the present suit essentially sought to litigate matters that were already conclusively dealt with in High Court Civil Suit No. 1124 of 1999, albeit against different parties who were, in substance, employees or agents of the original defendant.
