The Court held that both the Buganda Land (Amendment) Law, 1942, and the Land Transfer Ordinance, 1944, impose mandatory requirements that the consent of the Governor and the Lukiko be obtained not only for the original grant of a lease of Mailo land to a non-native, but also for any subsequent assignment of that leasehold interest to another non-native.
