The court found that the Sebutinde Report was authored and submitted solely by the chairperson without the participation or approval of the other two commissioners, in breach of Legal Notice No. 3 of 2002 and the Commissions of Inquiry Act. The commission was required to act as a collective body, with quorum defined as at least two members present, including the chairperson. The absence of a valid quorum and lack of approval rendered the report a nullity in law.
