Uganda v Nsubuga (HCT-17-CR-SC-0090-2022) [2024] UGHC 1256 (11 September 2024)

The court found that the accused, Nsubuga Godfrey alias Malobba, unlawfully caused the death of his son, Mubiru Tendo, through repeated physical abuse culminating in fatal assault on 14.5.2022. Eyewitness testimony and medical evidence established the accused's direct participation and the cause of death as internal hemorrhage from assault. Although the prosecution argued malice aforethought, the court determined that the evidence did not disclose a premeditated intent to kill but rather a pattern of unlawful physical abuse.
