Bank of Baroda (U) Ltd v Wilson Buyonjo Kamugunda [2006] UGSC 4 (17 January 2006)
The Supreme Court held that the appellant bank was negligent in opening and operating an account in the names of deceased persons without proper verification of their identities. The bank failed to take reasonable steps to ascertain the true identity of the account openers, despite the large sum involved and the fact that the purported account holders were long deceased. The respondent, as administrator of one of the deceased's estates, established entitlement to the cheque and its proceeds.
