The plaintiff breached the lease agreement by failing to comply with the building covenant requiring construction of buildings worth at least 500 million Uganda shillings by the stipulated deadline. Upon expiry of the lease on 31 December 2014, the suit land reverted to the 1st defendant, which was legally entitled to re-allocate the lease to the 2nd defendant. The evidence did not establish fraud or illegality on the part of the defendants, and the 2nd and 3rd defendants were lawfully in possession of the suit land.
