The Applicant established a prima facie case by showing ownership of the vehicle and alleging wrongful impounding and damage by the Respondent. The risk of auctioning the vehicle before determination of the main suit constitutes irreparable injury, as disposal would render assessment of damages and tax obligations impossible. The Respondent's statutory powers under the EACCMA do not divest the Court of jurisdiction to investigate alleged negligence or unlawful conduct.
