The High Court held that the respondents, as beneficiaries of the estate of the late landlord, had locus standi to sue for recovery of the property to protect the estate, even without letters of administration, as the appellant's continued occupation after expiry of the fixed-term tenancy endangered the estate. The tenancy agreement was for a fixed term of five years, expiring by effluxion of time on 30th April 2023, and the twelve months' notice provision applied only to premature termination, not to expiry.
