The court found that the power of attorney forming the basis of the plaintiff's locus standi was not stamped in accordance with Section 14 of the Stamp Duty Act Cap 339. Both parties agreed that stamp duty had not been paid. Section 31 of the Act renders unstamped instruments inadmissible as evidence. The court distinguished earlier authorities cited by the plaintiff's counsel as predating the current Stamp Duty Act and held that compliance with the Act is mandatory.
