Holding and result

The court found that the plaintiff's pick-up was involved in an accident with the defendant's pick-up, and that the defendant's driver was negligent in his manner of driving, specifically by suddenly returning to the road and causing a collision. The evidence was unchallenged and supported by witnesses and police reports. The defendant, as the registered owner, was vicariously liable for the acts of his driver, who was presumed to be acting within the scope of employment. The plaintiff was entitled to compensation for the replacement value of the pick-up, as repair was uneconomical, and to general damages for inconvenience and stress. The claim for lost income was rejected due to lack of documentary evidence. Costs and interest were also awarded.

Court disposition

Questions and positions

Legal issues

Party arguments

Applicant
The plaintiff argued that his pick-up was involved in an accident caused by the negligent driving of the defendant's driver, who overtook and then suddenly returned to the road, leaving no option but a collision. He claimed special and general damages for the loss sustained, including the replacement value of the vehicle and lost income.
Respondent
The defendant denied the plaintiff's claim in the written statement of defence but failed to appear at the hearing. No evidence was presented to contradict the plaintiff's case or to show that the driver was acting outside the scope of employment.

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • It is always better to do what is wiser; hence, replacement of the vehicle is preferable to repair when the latter is uneconomical.
  • The burden of proving that the driver was on a frolic of his own lies with the defendant, who failed to discharge it.
  • Interest on special damages runs from the date of filing the suit, while interest on general damages runs from the date of judgment.

Court disposition

judgment_for_plaintiff

  • The defendant shall pay the plaintiff Shs.12,000,000 as the replacement value for his pick-up.
  • The defendant shall pay the plaintiff Shs.2,000,000 as general damages.
  • The defendant shall pay interest on the amounts awarded at court rate: on the replacement value from the date of filing the suit till payment in full, and on general damages from the date of judgment till payment in full.
  • The defendant shall bear the costs of this suit.

However, the important question to answer is whethe r the plaintiff led evidence to prove the loss he claims to have suffered under those heads. Court will discuss below the contents of each head in turn. \par Under the head of special damages the plaintiff made two separate claims. The first claim is in respec t of the cost of repairs which are needed to replace the damaged parts of his pick-up. The second claim is for

loss of income in respect of the said pick-up from the day of the accident until now. For the first claim, Herbert Barungi (PW3 who is a valuer o}{\insrsid14770474\charrsid10954035 f motor vehicle}{\insrsid11501042\charrsid10954035 }{\insrsid14770474\charrsid10954035 from the Ministry of Works at Kabale) introduced in evidence an inspection report}{\insrsid11501042\charrsid10954035 (}{ \insrsid14770474\charrsid10954035 i.e. Exh. The plaintiff testified that each day his pick-up was on the road it brought in an average of shs.30,000/ as net profit. That was }{ \insrsid6769959\charrsid10954035 after deducting costs of repairs and service. The pick-up was on the road for 5 days each week.
