Holding and result

The High Court found that the trial magistrate committed serious errors in law and fact by shifting the burden of proof of ownership onto the accused and failing to evaluate the defence evidence. The prosecution did not prove beyond reasonable doubt the elements of criminal trespass under Section 302(b) of the Penal Code Act, as there was no evidence that the accused intimidated, insulted, or annoyed any person, nor any intent to commit an offence. The evidence established that the appellants had legitimate interests in the land as bibanja holders, supported by documentary evidence and unchallenged testimony. The trial magistrate's reliance solely on the complainant's registered proprietorship and disregard for the accused's rights constituted a misdirection. The prosecution's failure to cross-examine the defence evidence further strengthened the appellants' case. The appeal was allowed, convictions set aside, and any fines paid ordered to be refunded.

Questions and positions

Legal issues

Party arguments

Applicant
Counsel for the appellants argued that the trial magistrate erred by shifting the burden of proof onto the accused to prove ownership, whereas they maintained they were bibanja holders through succession. He contended that the prosecution failed to prove the essential elements of criminal trespass, specifically that the appellants had no claim of interest in the land. Counsel highlighted that the trial magistrate overlooked evidence of the appellants' interest and failed to consider exhibits showing their Kibanja rights. He prayed for the appeal to be allowed, convictions set aside, and fines refunded.
Respondent
No appearance or argument was made by the respondent. The Director of Public Prosecution was served but no State Attorney appeared and no explanation was provided to the court.

Court’s reasoning

  1. 01

Section 302(b) Penal Code Act, Cap. 120

The prosecution must prove all elements of criminal trespass beyond reasonable doubt; the accused has no duty to prove ownership or legal interest.

  2. 02

Moses Sebitengero Ganya v. Uganda, Cr. Appeal No. 32/95 (SC)

Evidence not cross-examined when an opportunity is given is presumed to be accepted.

  3. 03

Williamson Diamond Ltd v. Brown [1970] EA 1

On first appeal, the appellate court must subject the evidence to fresh and exhaustive scrutiny.

  4. 04

Constitution of Uganda; Land Act, Cap. 227; RTA Cap. 230

Bibanja holders and lawful occupants have constitutional and statutory protection of their interests in land.

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • The court noted that the prosecution failed miserably to prove the elements of criminal trespass beyond reasonable doubt.
  • The trial magistrate's statement that it was not the duty of the court to determine whether the accused were bona fide or lawful occupants was a misdirection in law and fact.
  • The court emphasized that bibanja holders have protected interests under the Constitution and Land Act, which afford a defence to criminal trespass charges.
  • The prosecution's decision not to cross-examine any of the accused's evidence was significant and presumed acceptance of their testimony.

Court disposition

appeal_allowed

  • Convictions set aside.
  • Any fines paid by the appellants to be refunded.
