01

Holding and result

The court found that the respondents had obtained the necessary permission to bring the suit in a representative capacity and that notice was properly published in accordance with Order 1 Rule 8 of the Civil Procedure Rules. The discrepancy in the number of persons listed in the court order and the published notice was deemed immaterial, as the law does not require an exact figure but rather a common interest among those represented. The application to strike out the suit was therefore without merit and was dismissed with costs awarded to the respondents.

Court disposition

application dismissed

Orders

  • The application to strike out the head suit is dismissed.
  • Costs of the application are awarded to the respondents.

Party arguments

Applicant
The applicant argued that the respondents did not seek or obtain court permission to sue on behalf of the persons listed in annexture B to the plaint, and that the court did not publish notice of the suit to those persons as required by law. Additionally, the applicant contended that the discrepancy between the number of persons in the court order (2500) and the published notice (2838) contravened Order 1 Rule 8 of the Civil Procedure Rules, rendering the suit invalid.
Respondent
The respondents, through an affidavit by their advocate, asserted that court permission was granted for the representative action and that notice was duly published in the Monitor Newspaper on 30th March 2005. They argued that the discrepancy in numbers was immaterial, as the basis for permission is common interest, not exact figures, and that representative actions can be brought on behalf of fluctuating groups.

05

Court’s reasoning

  1. 01

Order 1 Rule 8, Civil Procedure Rules

Representative actions are permitted to avoid multiplicity of proceedings where numerous persons share a common interest in the subject matter.

  2. 02

Order 1 Rule 8, Civil Procedure Rules; judicial interpretation

The exact number of persons represented in a suit is not material, provided there is a common interest among the group.

06

Ratio, limits and disposition

Ratio decidendi

The court found that the respondents had obtained the necessary permission to bring the suit in a representative capacity and that notice was properly published in accordance with Order 1 Rule 8 of the Civil Procedure Rules. The discrepancy in the number of persons listed in the court order and the published notice was deemed immaterial, as the law does not require an exact figure but rather a common interest among those represented. The application to strike out the suit was therefore without merit and was dismissed with costs awarded to the respondents.

Obiter and limits

  • Representative actions may be brought on behalf of fluctuating groups, and the ascertainment of exact numbers is not a legal requirement.
  • The purpose of representative actions is to avoid a multiplicity of suits over the same subject matter.

Court disposition

application dismissed

  • The application to strike out the head suit is dismissed.
  • Costs of the application are awarded to the respondents.
