Holding and result

The High Court found that, except for one witness, the evidence in the lower court was not given on oath, rendering the trial a nullity as the evidence lacked validity. The trial magistrate also failed to visit the locus in quo, which was necessary to ascertain the boundaries and the actual subject of the dispute. These procedural errors constituted a miscarriage of justice and fundamental errors, making the lower court's judgment unsustainable. The appeal was allowed, the judgment and orders of the trial court were set aside, and a retrial was ordered before a competent court.

Questions and positions

Legal issues

Party arguments

Applicant
The appellants argued that the trial magistrate's judgment was superficial, vague, and failed to consider the evidence in depth. They contended that the magistrate wrongly believed the respondent's case and did not properly evaluate the evidence. They also faulted the trial court for not visiting the locus in quo and claimed that these failures resulted in a miscarriage of justice and fundamental errors on the record.
Respondent
The respondent maintained that the trial magistrate properly directed his mind to the facts and law, and that the judgment need not be lengthy to be proper. He argued that the magistrate considered all available evidence and reached a correct conclusion. The respondent opposed the appeal and requested the court to uphold the lower court's judgment and orders.

05

Court’s reasoning

  1. 01

Section 40(3) of the Evidence Act (Cap 6) and general principles of civil procedure.

Evidence must be given on oath for it to be valid and have evidentiary value in court proceedings.

  2. 02

Practice direction and case law, including Civil Appeal No. 7 of 1995, Philip Onono v Emmanuel Okello.

A trial court should visit the locus in quo in land disputes to ascertain boundaries and the subject matter of the dispute.

06

Ratio, limits and disposition

Ratio decidendi

The High Court found that, except for one witness, the evidence in the lower court was not given on oath, rendering the trial a nullity as the evidence lacked validity. The trial magistrate also failed to visit the locus in quo, which was necessary to ascertain the boundaries and the actual subject of the dispute. These procedural errors constituted a miscarriage of justice and fundamental errors, making the lower court's judgment unsustainable. The appeal was allowed, the judgment and orders of the trial court were set aside, and a retrial was ordered before a competent court.

Obiter and limits

  • A judgment need not be lengthy to be proper, but it must be based on valid evidence and proper procedure.
  • Errors leading to a retrial are attributable to the trial court, not the parties, hence each party should bear its own costs.
  • The parties are ordered to maintain the status quo on the suit land until the retrial commences, after which interim orders may be made by the retrying court.

Court disposition

appeal_allowed

  • A retrial of the suit de novo by a court of competent jurisdiction is ordered.

  • Each party to bear its own costs of the appeal and the lower court proceedings.
  • Appellants and respondent to maintain the status quo on the suit land until the retrial commences.
