Holding and result

The Supreme Court held that its role as a second appellate court is limited to determining whether the concurrent findings of fact by the trial and first appellate courts are supported by evidence on record. The trial judge relied on the evidence of prosecution witnesses and the appellant's confession, which was corroborated by circumstantial evidence and the conduct of the appellant. The Court of Appeal properly re-evaluated the evidence and agreed with the trial judge's findings. The appellant's arguments regarding lack of corroboration and exclusion of other suspects were dispelled by the totality of the evidence, which placed the appellant at the scene and established his participation in the robbery. The retracted confession was corroborated by other evidence, and the appellant's disappearance from his duty station was inconsistent with innocence. The Supreme Court found no merit in the appeal and upheld the conviction, sentence, and compensation order.

Court disposition

appeal dismissed

Orders

  • Conviction for simple robbery upheld.
  • Sentence of 13 years imprisonment confirmed.
  • Order for compensation of UGX 184,000 to the victim maintained.

Questions and positions

Legal issues

Party arguments

Applicant
Counsel for the appellant argued that the Justices of Appeal failed to properly re-evaluate the evidence as required by law, resulting in a wrongful confirmation of the trial court's decision. He contended that the circumstantial evidence did not irresistibly point to the appellant's guilt, as there was no proof that the appellant knew where the money was placed or that other people were excluded from the banking hall. He further argued that the conviction was based on an uncorroborated retracted confession and that there was no evidence linking the recovered money to the stolen money. He prayed for the appeal to be allowed, conviction quashed, sentence and order set aside, and the appellant set free.
Respondent
Counsel for the respondent supported the conviction, sentence, and compensation order. He submitted that the Justices of Appeal properly re-evaluated the evidence and correctly found the appellant guilty. He argued that overwhelming circumstantial evidence pointed to the appellant's guilt, including his conduct and the corroboration of his confession. The appellant was left alone in the banking hall where the money was, and disappeared without handing over his station. The confession was admitted by consent, and its late challenge was an afterthought. The appellant's disappearance was inconsistent with innocence. He prayed that the appeal be dismissed.

Court’s reasoning

Rex v Hassan Bin Said alias Kimani Somali (1942) 9 EACA 62; s.5(a) Judicature Act; Kifamunte Henry v Uganda, Supreme Court Appeal No. 10 of 1997

On second appeal, the court is precluded from questioning concurrent findings of fact by the trial and first appellate courts, provided there was evidence to support those findings.

  2. 02

    Okeno v Republic (1972) EA 32

A second appellate court can only interfere with findings of fact where there was no evidence to support the finding, as this is a question of law.

  3. 03

General criminal law doctrine; applied in Ugandan jurisprudence

Retracted confessions require corroboration unless the court is satisfied of their truth.

Ratio, limits and disposition

Ratio decidendi

Obiter and limits

  • There is no standard procedure for re-evaluation of evidence by a first appellate court; what matters is that the evidence has been re-weighed.
  • Apart from the retracted confession, the conviction could still be sustained on other pieces of evidence on record.
  • The role of a second appellate court is not to retry the case but to ensure that findings of fact are supported by evidence.

Court disposition

appeal dismissed

  • Conviction for simple robbery upheld.
  • Sentence of 13 years imprisonment confirmed.
  • Order for compensation of UGX 184,000 to the victim maintained.
